What is the Procedure of Applying for Letters of Administration in the UK

When someone dies without leaving a valid will, their estate may need to be managed through Letters of Administration in the UK. This legal document gives an eligible person, known as an administrator, authority to deal with the deceased’s money, property and possessions. The rules outlined below apply primarily to England and Wales, as probate procedures differ in Scotland and Northern Ireland.

What Are Letters of Administration?

Letters of Administration provide legal authority to administer an estate where there is no will. The person who applies is generally the closest eligible living relative, following the order established by the intestacy rules. This commonly starts with a spouse or civil partner, followed by adult children.

Once granted, the administrator can generally:

  • Identify and collect the deceased’s assets
  • Deal with banks and other asset-holding institutions
  • Pay legitimate debts and liabilities
  • Handle the estate’s financial affairs
  • Distribute the remaining estate according to the intestacy rules

How to Apply for Letters of Administration

The application process involves several important stages. Accurate information and proper preparation can help prevent unnecessary delays.

Establish Whether Probate Is Required

Determine whether the organisations holding the deceased’s assets require a grant before releasing or transferring them. Some assets may pass automatically, particularly certain jointly owned assets.

Establish the Estate’s Value

The administrator needs to identify the deceased’s assets, debts and other financial interests and estimate the overall value of the estate. This information is required when making the probate application.

Check Inheritance Tax Requirements

Before applying, establish whether the estate needs to be reported for Inheritance Tax purposes. Where full details are required, an IHT400 may need to be submitted and any required tax payment started before the probate application can proceed.

Submit the Application

Applications can generally be made online or by post. Where there is no will, the paper application uses form PA1A. The online process also provides an application route specifically for Letters of Administration where the deceased died intestate.

The application requires relevant information about the deceased, the applicant and the estate. Supporting documents and information must be provided where required.

What Happens After the Application?

The Probate Service reviews the application. If it is approved, the administrator receives Letters of Administration, providing the legal authority to begin dealing with the estate. The document can then be supplied to organisations holding the deceased’s assets.

Applications are usually processed within around 12 weeks, although additional information or complications can make the process longer.

Understanding the procedure for Letters of Administration in the UK can make estate administration more manageable. Careful preparation, accurate estate valuation and timely completion of the required forms are important for avoiding preventable delays.
